I believe that we should be able to request ELECTRONIC documents. Providing paper only not only makes it prohibitively expensive but also prevents searching...two things I am sure they figure will cut down on the requests.

To the Board of Education, Indian Prairie Unit School District 204:
As you may or may not know, on May 22, 2009 I hand delivered to the District 204 office, FOIA requests for copies of the following employment contracts:
Superintendent Stephen Daeschner Deputy Supt. Kathryn Birkett Asst. Supt. Nancy Valenta
According to Illinois law, cited below, the public body must provide the information requested within seven working days after receipt of the request or deny the request.
Further, as you are probably aware, the Illinois Supreme Court, on May 21, 2009 ruled in Stern v Wheaton-Warrenville Community Unit School District 200 (attached), that employment contracts of public bodies are public records subject to the Illinois Freedom of Information Act. The Court further stated that employment contracts do not fall within the exemption for personnel files in section (7)(1)(b). Finally, the Court said "an employment contract, as a whole, bears on the employee's public duties and, moreover, constitutes a contract dealing with the ***expenditures of public or other funds of public bodies...thus, with the exception ...for personal information, ....[the] contract must be disclosed in its entirety."
According to my calculation, the seventh working day is today, June 4, 2009. At this time, I have not received word as to the status of my request. I look forward to District 204's compliance with the law as it currently stands. I prefer to receive this material in electronic format. Thank you.

(5 ILCS 140/3) Sec. 3. (c) Each public body shall, promptly, either comply with or deny a written request for public records within 7 working days after its receipt. Denial shall be by letter as provided in Section 9 of this Act. Failure to respond to a written request within 7 working days after its receipt shall be considered a denial of the request.
