Let's recap: Collins handed Lockformer their butts on a silver platter over TCE in the groundwater. TCE was used at the peaker plant. Someone said (I am still trying to verify) that they did not test for TCE in the groundwater at Eola but a short list of other chemicals. M2 calls Collins a 'nincampoop'. So, we have an experienced lawyer in environmental matters who has a very large win under his belt on one side and a name caller on the other. Guess how this will turn out. I haven't heard who the district has hired to help Whitt with the Collins lawsuit. There was talk of the district hiring an environmental attorney. D204 says it will hire more attorneys
March 11, 2008“The lawsuit will be defended is all I can tell you at this point,” board President Mark Metzger said. Metzger added that the district will employ co-counsel to work alongside its attorneys from Whitt Law, but who that co-counsel will be has yet to be determined, he said.

" " In my opinion, these two serious environmental problems disqualify the Eola-Molitor property as a safe site for a school," Collins said." Yes, in his paid opinion as attorney representing a group trying to get the site moved. It's the opinion of a lot of people. The dangers of PCBS, EMF's, Railroads, gaslines, crude oil supply lines, deisel oil etc have been dicussed way before the Eola site was chosen. You have seen that documented. The proponents of the Eola site are always attacking the critics but never debating the real issues. That is a classic sign that even they know that they don't have a real arguement.

"Missing reports? Collins also said he is troubled by the exclusion of seven additional environmental reports from Monday's presentation. The reports are generated by Midwest Generation, which owns the 37-acre parcel in the northeast corner of the school site where the peaker plant was located. They were shown to the district, but, due to the confidentiality agreement that kept the study results from being released, they were are not available to residents, Collins said. Documents that were released confirm that between 1993 and 2002 more than 12,000 gallons of chemicals were spilled on the 15.5-acre site where a peaker plant operated from 1969 to 2004. In the 1970s and '80s no environmental regulations were enforced, Collins said. " What exactly does this mean? Arch, you would probably be the best to answer this question. Is he talking about spills you have documentation on that you showed the board from MWGEN filings? Or is he talking about the Phase II report? Or both? I have not yet finished going through it all yet. The 25000+ gallons of missing DFO from Jan to Feb 1993 I can not find any documentation on except what is in the DOE archives. I can not confirm if it was a spill or a miscalculation / mis measurement or anything else other than the numbers themselves as reported by ComEd.

This is the part of the report where they found Jimmy Hoffa's teeth. No, no, Sushi. You're so silly! Those are buried under the concrete pad on the MWGEN site. It's the real reason they don't want to disturb the area.

"Metzger said referencing these issues shows what kind of nincompoop Collins is."M2 is an embarassment to our community. Nincompoop?! Freaking unbelievable. And what about the missing reports? What is in them that the public doesn't know about? Must be something they don't want us to know about. Well, we're footing the bill, so I think we should know. Our leadership is horrible. I am appalled that he has to call people names. MM is acting like a child and he has no business being in charge anymore. How can anyone condone this behavior? He is out of control and being very reckless with his actions and his words.

I would never give the SB too much credit. They would just spend it on attorneys' fees. ;D

Arch: I'm concerned about your comment that TCE was used at the peaker plant. TCE is generally used as an industrial solvent and I can't imagine why the peaker plant would use it in any large quantity. I do understand why Lockformer would have used it.
I'm not questioning your accuracy, just trying to better understand the comment.
TCE is highly volatile - absent a spill, most of it would evaporate. If it was spilled, it generally does not migrate in the ground, unless it comes in contact with groundwater, in which case it can migrate great distances -- I believe that is what happened at the Lockformer site. If it is contained, it can be farily easily remediated.
(edit: removed the question about pcbs as the Tribune article answered it for me.)

I honestly don't know what more I can add. Our SB has completely lost any ounce of credibility that they still had. We have 3 lawsuits hanging over our heads (all very credible and strong IMO), a very questionable environmental site, and a supposed 2009 date looming over our heads. Our SB cannot honestly move ahead with the Eola site. Given the current situation they can't possibly purchase the Eola land without knowing the outcome of BB.
Why in the world can't the SB and their crack legal team sit down with Brach, Brodie, NSFOC, Shawn Collins, whoever else, and work something out? At what point will they stop looking at Eola and realize they can't build there? Do we have to wait for a $20M settlement for Brach, a $20M+ settlement for Brodie, big $$$ estimates for remediating the Eola land, to stop? What happens when Midwest Gen decides to pull out?
Let's see in the process the SB has blamed Brach/Brodie, Linda Holmes, Tom Cross, Judge Killander, legislative body (for not approving QT), Shawn Collins, NSFOC, and especially Tall Grass for getting in their way. Did I forget anyone else? IMO, the SB underestimated the power of the people and once NSFOC got involved and started calling the SB out is when their carte blanche deals went south. This entire process has finally gotten others in the community to wake up and start following the antics of our SB. Their days of free reign are long gone and that's a good thing.
By the way, does anyone know who the HazMat guy was? I absolutely loved his creativity. BRAVO. I wish he'd have made the front cover of the Sun it would have gone well with the hot spots headline ;D.

This idiot (sorry for name calling.....well actually it is name calling if not a fact which it is ;D) has 4 years in office. This is going to be a looooooooooong bad ride.

I have another question: the Sun article indicated that EMF levels were less than background. How is that possible? If there were no lines, whatever the emf level was woould be background levels. Are we to believe that the power lines reduced the emf levels? How else can it be less than background? That's ridiculous.
