Opponents of Metea Valley High School lose trial bid By Art Barnum | Tribune reporter April 24, 2008 A judge Wednesday denied an opposition group's bid to hold a trial before construction begins on Metea Valley High School at an Aurora site approved by Indian Prairie School District 204. After rejecting Neighborhood Schools for Our Children's request for a trial as early as next month, DuPage County Judge Kenneth Popejoy offered several suggestions, such as meditation, for resolving the group's differences with the district. The group, which filed suit in March, opposes building the district's third high school anywhere but the 80-acre Brach-Brodie site at 75th Street and Fort Hill Drive. The District 204 board originally considered that site but decided on one near Eola Road, south of the Reagan Tollway, after it deemed the Brach-Brodie site too expensive. Shawn Collins, attorney for the citizens group, told Popejoy that he wanted the trial before the district spends too much money on construction of the school. He said foundation work was set to begin June 13. Popejoy said legal requirements for a trial could not be circumvented. Although he suggested that both sides consider mediation, he said the citizens group could file a request for a preliminary injunction to halt construction. Collins told Popejoy that he was considering filing the request, but both sides agreed to look at mediation and report back to Popejoy on May 2. I agree that the open meeting act item is interesting. But there was an item on the agenda for taking action on the land deal. It was put on Friday afternoon.
I am certainly not defending this process that seemed to fly in the face of any definition of transparent bid based procurement by a government body; however, was it really a violation of the open meetings act? I guess it is up the the judge to decide...

If you go back and look at the wording in the agenda for 1/22 and compare to the 4/14 meeting I see the potential violation.
Land contracts (4/14) or land purchase (1/22).
Big difference to me! Also, they've been signing land contracts for quite some time now. I find it deceptive.

I guess it is up the the judge to decide... It didn't say to take action on land deal. It said "Recommendation: That the Board of Education take such action on the land contracts for Metea Valley High School as presented and discussed in Executive Session." This could have been anything from canceling the the remaining church contract, canceling construction contracts, canceling MWG contract, etc... Before Daecshner said anything after puplic comment, the public had no idea what they were really voting on.
