Sure anyone can file a suit...winning is another matter. I just hope when they lose they have to pay all legal fees. I have no idea whether or not someone could actually win such a lawsuit, and who would end up paying the legal fees. My concern is that it could delay the opening of the school. A lot of people think the whole BB situation has been a mess, but I don't this train wreck has even left the station yet. This could get very ugly.

I'm still not sure on what grounds. But, you can get a TRO by just throwing a bunch of crap out there that seems reasonable. Breach of fiduciary duties, conflicts of interest, etc.

This district is going to be torn apart, top to bottom and east to west. But I do think the school will probably end up at AME in 2010, costing more money than BB in the end. They had better be darn sure there is an absolute 0% chance of any issues whatsoever with the EMF and the peaker plant removal because if they run into any problems and have to ask for more money there is not a chance in heck it would pass. I kind of think if they cry wolf with threats of cutting activities or split shifts if we don't pass it - like last time- well, we're all a little wiser now.

They, Macom, send us info saying they are working hard on negotiations, etc. They have had plenty of opportunities to be the guys riding in on the horse to save the day. There must just be too much bad blood between the district and Macom to make this work. I am still trying to contain the level of anger the is flowing through me when I see that this 2009 date being pushed. Can you say land price promise all over again.. grrrr.. I know it will sub-side at some point.

Now let's say BB realizes that the SB is serious...which I think they are. They now know what their new price offer has to be, and it's lower than what they could have gotten. IMHO that's they only way to even consider BB anymore. I want to be on record, if that happens, I'd support it. Otherwise it's AME.....

I agree with gumby, to many parties/complexities with this site, when an alternative just down the road. Furthermore, I dont see Lehman/Macom as a motivated seller anymore. Instead he should lobby for Hamman. Then he has his cake (nearby new HS) and can eat it too (sell more houses, so he thinks).
